Eat Shoot Drive OY Terms & Conditions

1. General terms

By participating in or booking Eat Shoot Drive OY’s programs or any related products or services you agree to the terms and conditions set out below. The prices and services offered by Eat Shoot Drive OY are described in the specific program descriptions for each service separately. The language used during all our services is English.

2. Booking and confirmation

Once Eat Shoot Drive OY has confirmed your booking the contract is made between you and Eat Shoot Drive OY. For all bookings, you will receive a confirmation of your booking to your email.

3. Cancellations

In case of cancellation, you need to contact Eat Shoot Drive OY as soon as possible via email or phone. We will cancel your booking when we receive your cancellation request and booking reference in writing to hello@eatshootdrive.com and will confirm the cancellation in writing by email.

If a booking is cancelled later than 5 pm 7 days prior to your booking, no refund shall be given.

If Eat Shoot Drive OY for some unforeseen reason has to cancel your booking a full refund will be given.

 

You are responsible to inform Eat Shoot Drive OY in writing of any possible changes in contact details. If such changes are not informed, Eat Shoot Drive OY can not be held responsible for any delays, changes in schedule or any other service related issues caused by incorrect contact details.

 

You are obliged to be on time according to the schedule of the program. Being late does not give right to any refund or rescheduling of the program.

4. Payment

Payment is made online at the time of booking. We may also accept payment by credit card or cash in Euros for last minute bookings. The prices given by Eat Shoot Drive OY include VAT according to the taxation laws of Finland. Eat Shoot Drive OY reserves the right to change the prices if any extra costs occur. Any additional costs will always be communicated to you prior to any additional charges being applied.

5. Liability

During the photoshoots, expeditions and tours Eat Shoot Drive OY follows the appropriate health and safety regulations in accordance with laws and regulations as applicable in Finland. Standard guidelines and practices recommended for different program services are always followed when delivering these services. Eat Shoot Drive OY can only be held liable for injuries and material damages during the delivery of the service that are caused by negligence by the company or its employees.

6. Liability insurance

Eat Shoot Drive OY has a general third-party liability insurance with If Vahinkovakuutus Oyj.

7.  Travel insurance

Eat Shoot Drive OY exercises activities that can be located in remote areas and away from populated centres. It is highly recommended that you have personal travel insurance when joining our programs.

​

8. Safety

Eat Shoot Drive OY reserves the right to change or re-schedule the planned program if necessary. Due to bad weather conditions, extreme cold or other safety reasons the Company has the right to cancel the program. In case of cancellation by Eat Shoot Drive OY due to extreme weather your reservation will be fully refunded. Eat Shoot Drive OY reserves the right to refuse a participant in a program if he or she is seen as a potential danger to him/herself or other participants or is under the influence of drugs or alcohol. If a participant is in poor health or is physically incapable of joining the program, Eat Shoot Drive OY may refuse participation in the program.

During the expeditions and tours, we sometimes may use oil lamps or build an open fire. Eat Shoot Drive OY cannot be held responsible for any injuries or damaged valuables caused by fire or any other hot objects or oil lamps. By taking part to our programs you understand these risks.

As a participant of our services you shall acknowledge that the products and services organised by Eat Shoot Drive OY and services included in our activities can be physically demanding and may involve a significant amount of risk to a customers health and safety. You acknowledge these potential risks to health and safety and by taking part to our activities you acknowledge that you participate in the program at your own risk.

9. Responsibility

Eat Shoot Drive OY cannot be held responsible for any damage or disappearance of valuables during the programs. It is your responsibility to take good care of your belongings. As a participant in our programs you are responsible for the equipment we provide and lend to you. If any damage is done on purpose or by accident or any equipment provided by Eat Shoot Drive OY disappear during the program, we reserve the right to charge the costs of caused damage from the participant.

10. Wilderness adventure program

Eat Shoot Drive OY’s wilderness adventure program may include some activities that are organised by other local suppliers and partners. Eat Shoot Drive OY is acting only as a selling agent of these activities and implementation is carried by our local suppliers.

These wilderness adventure programs include separate cancellation terms conducted by the local suppliers and partners. In each case, the local supplier’s and partner’s cancellation terms will replace the ones mentioned under section 3 of these terms & conditions.

Eat Shoot Drive OY can not be held liable for personal injuries or material damage arising from accidents that have happened during the delivery of the services which are provided by the local suppliers and partners.

 

11. Force majeure
Eat Shoot Drive OY shall not be held liable for any default, damage or loss due to a condition force majeure or to unreasonable impairment of Eat Shoot Drive’ OYs  operations due to a similar cause (including but not limited to war, strike, weather, lack of snow, or any other natural condition). If encountered a force majeure condition, Eat Shoot Drive OY shall immediately notify you in writing by email thereof, and shall keep you fully informed of the continuance of the force majeure condition and of any relevant change of circumstances whilst such force majeure continues.

 

12. Weather conditions

All activities provided by Eat Shoot Drive OY are considered “Rain or Shine” and will be carried out regardless of weather conditions. Only due to extreme weather conditions, such as extreme cold or other safety reasons the Company has the right to cancel the program. In case of cancellation by Eat Shoot Drive OY due to extreme weather your reservation will be fully refunded.

13. Other

During Eat Shoot Drive OY’s activities your guide will take photos of the nature, people and activities. Eat Shoot Drive OY reserves the right to use these photos in any marketing and business purposes without expressed written or oral permission. Any person desiring not to have photo taken of them or distributed must notify us in writing by contacting us through email: hello@eatshootdrive.com

14. Applicable Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the Finnish Law. The Finnish Courts shall have the exclusive jurisdiction to settle any dispute, controversy or claim related to such a demand. The District Court of Lapland (in Finnish: Lapin Käräjäoikeus), shall be the court of first instance.

15. Severability

If any part, term or provision of these terms and conditions is partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.

According to the General Data Protection Regulation (“GDPR”), the personal data controller of a register (the “Controller”) is obligated to inform the register’s data subjects in a clear manner. This Privacy Policy fulfils this informing obligation.

2. Personal data we collect

The Customer Register contains the following information:
 

Contact & customer information

• Name

• E-mail

• Phone number

• Country of origin

• Any other information provided

• Information of products/services bought

When you browse our website, we may collect:

• Information about the Customer’s browsing behaviour on our website.

• Information about the way the Customer accesses our digital services, including operating system, IP address, online identifiers and browser details.

When the Customer buys our services from our webpage, we may collect:

• The Customer’s personal details, including your name, address, country of origin, email address, phone number.

• Relevant medical data and any special, dietary requirements or disability requests.

• Any other information provided by the Customer.

When the Customer contacts us by email, phone, message, social media or contact form, we may collect:

• Conversations between Eat Shoot Drive OY and the Customer;

• The Customer’s personal details, including name, address, country of origin, email address, phone number;

• Relevant medical data and any special, dietary or disability requests provided by the Customer.

• Any other information the Customer provides.

3. Legal basis and purpose of processing personal data

Processing of personal data is based on the contract and customer relationship between a Customer and Eat Shoot Drive OY. We collect data to organise and deliver services and products for the Customers. Data is mostly used to identify any Customer who has made a booking for services provide by Eat Shoot Drive OY. Without this data, Eat Shoot Drive OY is unable to deliver the service for the Customer.

Data can be also used to analyse the market, Customers and services for developing and improving the quality of the services. It can be used to send invoices and to manage Customer relationship and communication. Some data is also used in direct marketing and advertising targeted at Eat Shoot Drive OY’s customers. The Customer has the right to refuse the use of their data for marketing purposes and must confirm this in writing to hello@eatshootdrive.com

Data collected by Eat Shoot Drive OY is gathered from the following sources:

• Telephone conversations, or sent by text message or WhatsApp.

• Making a booking through our webpage.

• Making a booking through any third-party.

• Sending a message through the contact form in Eat Shoot Drive OY’s webpage.

• Any data collected through marketing services used by Eat Shoot Drive OY.

• Using social media platforms (Facebook, Twitter, Instagram, Google+).

• Meetings with the customer directly.

• Any other way or form that the Customer provides Eat Shoot Drive OY with information.

4. Transfer of personal data outside of EU/EEA

Eat Shoot Drive OY may use subcontractors outside EU when collecting data and providing services. Personal data may be transferred outside EU only if this is necessary for organising and delivering services for the Customer/s. This may concern the servers Eat Shoot Drive OY uses to store the Customer Register. If any data is transferred outside EU, Eat Shoot Drive OY’s subcontractors must follow general data protection regulation of EU. Eat Shoot Drive OY will safeguard the sufficient level of personal data protection by e.g. agreeing on matters related to the confidentiality and processing of personal data in compliance with legislation. Personal data of a Customer is never transferred to third parties for any sales- or marketing purposes.

5. Regular disclosure of data

Eat Shoot Drive OY will obtain confirmation that all service providers are complying with data protection legislation. For more information about our service providers, please contact us. Personal data can be transferred to officials according to current legislation and law.

6. Data Security and retention
User data is accessible only by employees of Eat Shoot Drive OY who have justifiable reason to access and process the information. The Customer Register can be only accessed with user rights and password. All the employees of Eat Shoot Drive OY are under professional confidentiality when processing any data related to the Customer Register. We may also outsource the processing of personal data partly to a third party, in which case we will guarantee with contractual arrangements that personal data is processed in compliance with valid data protection legislation and otherwise appropriately.
Eat Shoot Drive will retain personal data for as long as necessary to organise and provide services and products for customers. Personal data may be retained for Eat Shoot Drive OY’s marketing purposes for as long as seen necessary to maintain a relationship with the customer.

7. Customer rights

• The Customer has the right to receive him/her personal data from the Customer Register and to request to change or complete incorrect or insufficient information.

• The Customer has the right to request a copy of the personal data held of him/her.

• The Customer has the right to request in writing the deletion of his/her personal data from the Customer Register.

• The Customer has the right to complain in writing to the Contact Person if he/she feels that Eat Shoot Drive OY is violating the effective data protection regulation when processing personal data.

• The Customer has the right to forbid the use of personal data for direct marketing.

Any requests related to rights mentioned above must be made in written form by email to hello@eatshootdrive.com. The Company will answer to requests within the defined terms of general data protection regulation of EU.

The Customer is responsible to inform Eat Shoot Drive OY of any possible changes in personal data. If changes are not informed, Eat Shoot Drive OY can’t be held responsible for any delays, changes of schedule or any other service related issues caused by incorrect customer details.
 

8. Cookies

Our website may use cookies to enhance the user experience. Web browser places cookies on hard drive of the user. The website user may prohibit the use of cookies by changing the browser settings. This may, however, affect the user experience of the website or website might not function properly.
